LAS VEGAS (KSNV) — A new criminal complaint has been filed against Nathan Chasing Horse, days after the Nevada Supreme Court dismissed the initial indictment.
Court records show prosecutors filed two counts against Chasing Horse allegingusing or permitting a minor to produce pornography and possession of pornography involving a minor.
Charges were initially filed in Las Vegas Justice Court over the weekend, and bail was reset to $200,000. The case was later transferred to North Las Vegas Justice Court, where Chasing Horse was scheduled to appear for an arraignment hearing Wednesday morning.
Authorities first arrested Chasing Horse in January last year on suspicion of18 felonies, including sexual assault of a minor, child abuse and kidnapping.
His attorney argued that some evidence presented to the grand jury, including an improper definition of grooming that was presented without expert testimony, had tainted the state’s case. The attorney also said prosecutors also failed to provide the grand jury with exculpatory evidence, including inconsistent statements made by one of the victims.
Nevada Supreme Court justices agreed with Chasing Horse’s defense, writing that “the combination of these two clear errors undermines our confidence in the grand jury proceedings.”
Their ruling dismissed the indictment without prejudice, meaning the justices allowed the charges to be refiled. Shortly after the ruling was published, Clark County District Attorney Steve Wolfson said he intended to return to the grand jury to seek another indictment.
Federal prosecutors in Nevada also dismissed their long-dormant sex abuse case against Chasing Horse.
